Reese Witherspoon and her husband Jim Toth were arrested and jailed in Atlanta on Friday for drink driving.
Police pulled them over when they noticed their Ford Focus veering into the wrong lane.
Toth, 42, had a blood alcohol reading of 0.139 (the US limit is 0.08, higher than Australia’s limit of 0.05). Toth told police he had only had one drink at a restaurant hours earlier but his breath smelled heavily of alcohol, had droopy eyelids and watery, bloodshot eyes.
Witherspoon, 37, became agitated when her husband was placed under arrest.
The actress was told to stay in the car twice. “Mrs Witherspoon began to hang out the window and say that she did not believe that I was a real police officer”, the officer is reported as saying. “I told Mrs Witherspoon to sit on her butt and be quiet.”
She then got out of the car yelling at the officer that she was a “US citizen” and that she was allowed to “stand on American ground.”
She was then handcuffed and placed under arrest for “disorderly conduct (obstruction).”
The reporting officer said: “Mrs Witherspoon asked, ‘Do you know my name?’ I answered, ‘No, I don’t need to know your name.’ “I then added, ‘right now.’ Mrs Witherspoon stated, ‘You’re about to find out who I am’.”
The police report said: “Mrs Witherspoon also stated, ‘You are going to be on national news.’ I advised Mrs Witherspoon that was fine.”
Witherspoon and talent agent Toth married in March 2011, and have a son, Tennessee James Toth. They are currently in Atlanta filming The Good Lie.
The couple were released from custody at 3.30am on Friday, and are due to appear in court on Monday morning at 8am, US time.
